The General Terms and Conditions include the General Terms and Conditions for the use of the website (hereinafter “Website”) operated by Fodor-Berecz Anna E.V., as the service provider (hereinafter “Service Provider”) on www.budapestexperiences.com (hereinafter “Website”).

Both registered users and individuals who are not registered on the Website but access certain parts of the Website without registration are considered Users.

The provisions of these General Terms and Conditions shall apply to the use of the Website and to the purchase of all goods sold through the Website. The handling of user personal data is governed by the Data Protection Declaration.

1.1 Conditions of Use

1.1.1 Certain parts of the content of the Website are accessible to any User, and no registration is required to view the content.

1.2 Liability

1.2.1 The information provided on the Website has been placed there in good faith, but it serves only for informational purposes, and the Service Provider does not assume responsibility for the accuracy or completeness of the information.

1.2.2 Users may use the Website at their own risk, and they accept that the Service Provider is not liable for financial or non-financial damages arising during use, beyond responsibility for intentional misconduct, gross negligence, or criminal acts, and beyond liability for breaches that cause loss of life, physical harm, health, or beyond the scope of the liability.

1.2.3 The Service Provider disclaims all responsibility for the behavior of users of the Website. Users are fully and exclusively responsible for their own behavior, and in such cases, the Service Provider fully cooperates with authorities for the investigation of infringements.

1.2.4 Users are required to ensure that their use of the Website does not infringe the rights of third parties or violate any laws, either directly or indirectly.

1.2.5 The Website may contain links leading to the websites of other providers. The Service Provider assumes no responsibility for the privacy practices and other activities of these providers.

1.2.6 The content made available by users on the Website during use may be reviewed by the Service Provider but is not obligated to do so, nor is the Service Provider required to search for signs of illegal activity concerning the posted content.

1.2.7 Due to the global nature of the Internet, Users agree to comply with the provisions of applicable national laws when using the Website. If any activity related to the use of the Website is not allowed under the laws of the User’s country, the User bears sole responsibility for the use.

1.2.8 If the User identifies objectionable content on the Website, they must promptly notify the Service Provider. If the Service Provider finds the report to be well-founded in good faith, it has the right to delete or modify the information without delay.

1.3 Copyrights

1.3.1 The Website is protected by copyright. The Service Provider is the copyright holder or authorized user of all content displayed on the Website and in the services accessible through the Website, including any copyrighted works, visual, audio, and textual content, as well as their arrangement, and other intellectual creations (including graphics, images, materials, the layout of the Website, editing, used software, and other solutions, ideas, implementations). Therefore, the Website, its graphic elements, images, text, and technical solutions are intellectual property of the service provider and are protected by copyright. Copying them, in whole or in part, violates copyright.

1.3.2 Storing or printing content or certain parts of the content on the Website to hard drives, SSDs, USB drives, or SD cards for personal use is permitted.

1.3.3 Beyond personal use – e.g. storage in databases, sharing, publication, making downloadable, or commercial distribution – is possible only with the prior written consent of the Service Provider.

1.3.4 The Service Provider reserves all rights to every element of its service, especially its search engines and other internet software, the domain name www.budapestexperiences.com, subdomains, subpages, as well as its internet advertising spaces. All activities aiming at listing, arranging, archiving, hacking, or reverse-engineering the Service Provider’s database are prohibited without specific permission. Using the advertising management interface or bypassing search engines provided by the Service Provider without separate agreement or using services designed for this purpose is also prohibited without prior written permission, modifying, copying, adding new data, or overwriting existing data in the Service Provider’s database.

 

2) PLACING AN ORDER

2.1 Registration

2.1.1 Registration on the Website is possible. The primary purpose of registration is to simplify the purchase process, take advantage of convenience services, and track orders.

2.1.2 During registration, the User provides their contact details (name, email address, and phone number), which are necessary for order fulfillment.

2.1.3 The User is required to provide accurate and complete registration information and to notify the Service Provider immediately if their data changes.

2.1.4 The Service Provider reserves the right to suspend or terminate the User’s registration without prior notice if the User violates the terms of use.

2.2 Orders without Registration

2.2.1 Users may place orders without registering. In this case, they need to provide their contact information and other details necessary for order fulfillment.

2.3 Order Process

2.3.1 Users can place orders through the Website. The Service Provider sends an automatic confirmation email to the User after the order is placed.

2.3.2 The order confirmation email includes details of the order, the ordered products, their prices, and the contact details of the Service Provider.

2.3.3 The User may request modification or cancellation of the order by contacting the Service Provider’s customer service.

2.3.4 The contract between the User and the Service Provider is established when the Service Provider sends a confirmation email to the User, which confirms the acceptance of the order.

2.3.5 The Service Provider is not obligated to fulfill orders for products listed on the Website with incorrect prices due to technical errors. If the actual price is higher than the price displayed on the Website, the Service Provider will contact the User and provide the option to reconfirm the order at the correct price or to cancel the order.

2.4 Payment Methods

2.4.1 The Service Provider offers various payment methods for orders, including bank transfer, credit card payment, and online payment solutions.

2.5 Shipping and Delivery

2.5.1 The Service Provider ships products within the territory of Hungary.

2.5.2 Delivery times are estimated and provided by the Service Provider in good faith. However, the Service Provider is not responsible for delays due to external factors beyond its control.

2.5.3 The User may choose from available delivery options during the order process.

2.6 Product Availability

2.6.1 The availability of products on the Website is indicative and may change.

2.6.2 If a product is not available after the order is placed, the Service Provider will inform the User and offer alternatives or cancel the order.

2.7 Right of Withdrawal

2.7.1 The User has the right to withdraw from the contract without providing a reason within 14 days from the receipt of the product.

2.7.2 The User must notify the Service Provider of their decision to withdraw from the contract in writing.

 

3) PAYMENT

3.1 Bank Transfer in Advance

The User pays the purchase price of the ordered products and the cost of delivery in advance to the Service Provider’s bank account at K&H Bank, account number 10401055-86768548-75681009, via bank transfer. In the “Notes” section of the transfer, it is necessary to include the order number in all cases. In the case of a bank transfer, the User is only entitled to receive the ordered products after the transfer has been credited.

3.2 Payment through Barion with a Credit Card

Online credit card payments are processed through the Barion system. The Barion system handles online credit card payments. The merchant does not have access to the credit card data. The service is provided by Barion Payment Zrt., an institution supervised by the Hungarian National Bank, authorization number: H-EN-I1064/2013.

The immediate payment of the total order amount is made through the Barion Gateway system. To complete the transaction, the Service Provider’s system automatically redirects the User to the Barion page, where they can easily settle the total order amount by providing the requested information. Barion is not notified by the Service Provider about personal data related to the order or information about the purchased content. On the other hand, the Service Provider also does not receive information about the content of the payment page; only Barion can access that information. After payment, the User receives information about the transaction result on the Website. To make a card payment, the User’s internet browser must support SSL encryption. The amount paid as the final order amount is immediately reserved on the User’s current account.

3.3 Invoice

The Service Provider will provide the User with an invoice to confirm payment at the latest when the ordered products are received by the User. The Service Provider cannot split an invoice within a single order. If the User wants a separate invoice for certain items, they need to order those items separately.

The invoice will be sent to the User’s provided email address by the Számlázz.hu system after order fulfillment.

3.4 Purchasing from Abroad

3.4.1 The Service Provider accepts orders from abroad, but delivery can only be fulfilled within the territory of Hungary.

 

4) DELIVERY

4.1 Method of Delivery

The Service Provider uses the Webshippy logistics company to deliver the product to the User.

4.2 Delivery Times

The delivery time for available vouchers and associated gift extras (such as Experience Boxes, printed gift vouchers) generally ranges from 2 to 6 days, depending on the region of Hungary requested by the User.

4.3 Cost of Delivery

The cost of delivery can be found by the User on the checkout page after selecting the appropriate delivery option.

 

  1. RIGHT OF WITHDRAWAL AND REFUND

The provisions in this section apply solely to natural persons acting outside their trade, business or profession, who purchase, order, receive, use, benefit from, or communicate about goods, as well as recipients of commercial communications and offers (hereinafter referred to as “Consumer”).

5.1 The Consumer is entitled to withdraw from the contract of purchase of the product based on the detailed rules of contracts between consumers and businesses, as specified in Government Decree 45/2014 (II.26) of the Hungarian Government, under the following conditions:

  1. a) In the case of a product, b) In the case of multiple products, if the services of individual products are provided at different times, the last provided product, c) In the case of a product consisting of multiple items or pieces, the last delivered item or piece, d) In the case of a product that needs to be provided regularly within a specified period, the first service,

The Consumer is entitled to withdraw from the contract within fourteen (14) days of the day of taking possession of the product by the Consumer or by a third party other than the carrier and designated by the Consumer.

5.1.1 The Consumer is entitled to exercise the right of withdrawal within the period between the day of the conclusion of the contract and the day of receipt of the product.

5.1.2 If the Consumer wishes to exercise the right of withdrawal, they are required to communicate their clear statement of withdrawal, indicating their intention to withdraw (by post, fax, or electronically) using the contact details provided in Section 1 of these Terms and Conditions, to the Service Provider.

5.1.3 The Consumer exercises the right of withdrawal within the deadline if they send their statement of withdrawal to the Service Provider before the expiry of the specified deadline (14 days). For the purposes of calculating the deadline, the Service Provider considers the date of Personal Receipt for personal receipt, the date of receipt of the package for home delivery, and the date of sending the email for electronic performance, as of which 14 days are calculated.

5.1.4 In both cases, the Service Provider immediately confirms the receipt of the Consumer’s statement of withdrawal by email.

5.1.5 In the case of written withdrawal, it is considered valid if the Consumer sends their statement within 14 calendar days (even on the 14th calendar day) to the Service Provider.

5.1.6 The Consumer must send their letter by registered mail to prove the date of dispatch.

5.1.7 In the case of withdrawal, the Consumer is required to return the ordered product to the address specified in Section 1 of these Terms and Conditions without undue delay but within 14 days from the date of communication of the withdrawal statement. The deadline is considered met if the Consumer sends (hands over to the post or the courier they ordered) the product before the 14-day deadline.

5.1.8 The cost of returning the product to the Service Provider’s address is borne by the Consumer. The Service Provider is not obliged to accept cash-on-delivery parcels. In addition to the cost of returning the product, no other costs shall be borne by the Consumer in connection with the withdrawal.

5.1.9 If the Consumer withdraws from the contract, the Service Provider shall refund all payments received from the Consumer without undue delay and in any case, within 14 days from the receipt of the Consumer’s withdrawal statement. This includes the delivery cost, except for additional costs incurred due to the Consumer’s choice of delivery method other than the cheapest standard delivery method offered by the Service Provider. The Service Provider is entitled to withhold the refund until the product is returned or until the Consumer has provided evidence of having returned the product: whichever occurs first.

5.1.10 When making a refund, the Service Provider uses the same payment method as used in the original transaction, unless the Consumer expressly consents to a different payment method; the Consumer shall not incur any fees as a result of such refund.

5.2 The right of withdrawal does not apply to non-pre-manufactured products (such as experience boxes) that have been manufactured based on the Consumer’s instructions or at their explicit request, or to products that have been clearly personalized for the User.

5.3 If the Service Provider delivers a substitute product instead of the product specified in the contract, in the case of withdrawal, the Service Provider shall bear the costs of returning the product.

5.4 The purchased vouchers can only be refunded by the Service Provider within 14 working days if no successful appointment booking has been made.

 

  1. RESOLUTION OF DISPUTES

6.1 Place of Complaint Handling

Users can present consumer complaints related to the product or the activities of the Service Provider through the following contact details:

6.2 Method of Complaint Handling

The Service Provider will address verbal complaints immediately if possible. If immediate resolution of a verbal complaint is not possible, or if the nature of the complaint dictates, or if the User does not agree with the handling of the complaint, the Service Provider will record a protocol of the complaint – which will be kept for five years, along with the substantive response to the complaint.

For verbal complaints presented in person, the Service Provider will provide the User with one copy of the protocol on the spot, or if this is not possible, the Service Provider shall act according to the written complaint rules outlined below.

In the case of verbal complaints made over the phone or through other electronic communication means, the Service Provider will send the User a copy of the protocol along with the substantive response.

In all other cases, the Service Provider will follow the rules for written complaints.

A complaint recorded via phone or other communication means will be assigned a unique identifier by the Service Provider, making it easier to retrieve the complaint later.

The Service Provider will respond to written complaints within 30 days. Sending the response by mail constitutes implementation under this agreement.

In case of rejecting a complaint, the Service Provider will inform the User about the reasons for the rejection.

6.3 Timeframe for Complaint Handling

The Service Provider will receive User-submitted complaints on weekdays between 8:30 AM and 4:30 PM at the direct contact details provided in section 8.1.

6.4 Other Remedies

If a consumer dispute between the Service Provider and a User that qualifies as a consumer cannot be resolved through negotiations, the consumer User can contact and initiate the proceedings of the competent conciliation body based on their domicile or residence. Furthermore, the following legal remedies are available to the User:

Filing a complaint with consumer protection authorities, Initiating court proceedings.

7) UNILATERAL AMENDMENT OF GENERAL TERMS AND CONDITIONS

The Service Provider has the right to unilaterally modify these General Terms and Conditions with prior notice to users on the Website. The Service Provider will publish the modified terms on the Website with sufficient advance notice. The modified provisions will become effective towards Users upon first use of the Website and for subsequent orders and further use of the Website.

 

8) RETENTION OF OWNERSHIP

Until full payment of the final amount of the order, the product remains the property of Fodor-Berecz Anna E.V.

 

9) OTHER PROVISIONS

The Service Provider reserves the right to carry out any changes, corrections on the Website without prior notice.

The Service Provider also reserves the right to move the Website to another domain name.

 

10) CONDITIONS OF USING THE VOUCHER

The User has the possibility to notify the Service Provider within 30 days of the purchase that they do not want to use or gift the voucher after all. If the User communicates this in writing to the customer service at the email address info@budapestexperiences.com, in that case, the Service Provider is obligated to refund the value of the purchased voucher, including possible packaging and delivery charges.

The Service Provider is entitled to exchange the voucher for another experience free of charge until the end of its validity period, and before its use. If the selected experience has a higher value than the purchased voucher, the difference must be paid.

The validity of the voucher is 365 days from the date of purchase. The expiration date is indicated on each voucher. The Service Provider cannot change the validity period of the voucher, so using it beyond the expiration date is not possible. In this case, the User loses the right to redemption. The Service Provider cannot accept any objections in this regard.
